The Articles of ACARD Online Shopping All consumers who shop on the website of ACARD Technology Corp. (hereafter referred to as ACARD) should read the following articles closely. The stipulation of these articles aims to protect the interests of ACARD and all consumers who do the online shopping on the ACARD website (hereafter referred to as consumer). When the consumer presses the key of “I agree to follow the rules above” or shops on the ACARD website, it is regarded as his agreeing all the articles set here.
The Safety of Personal Data 1. In order to trade successfully, including payment and delivery, the consumer should guarantee his data are correct. If there is any change, he shall e-mail to service@acard.com immediately. The consumer shall be responsible for his affected interest if he is lazy to notify or he provides incorrect data.
2. Besides the adoption of safe trade mode, ACARD will keep the consumer’s data secret. It won’t leak or offer the data to any other third party except the related or coordinated manufacturer of product or provider of service.
3. Under the circumstances below ACARD has the right to examine or provide the consumer’s data to authorities:
l According to the law, or the command of the judiciary or any other authority;
l In order to execute the articles set here, or when the consumer violates the articles;
l In order to maintain the normal operation and safety of ACARD system;
l In order to protect the interests of ACARD, other consumers or any other third party.
4. The consumer should keep his personal data, payment data (including credit card data) and membership code secret. All actions that happened after entering the system using the consumer’s account and code are regarded as the actions of the holder of that account and code.
Online Shopping 1. ACARD and the related or coordinated manufacturer or provider are responsible for all the quality, warranty and after-sale service of the products or services on the ACARD website, and ACARD will also help the consumer to solve any problem or quarrel resulting from the online shopping with all its efforts.
2. Once the consumer does the online shopping, it means that he is willing to buy the product or service and follow the trade rules. If the consumer’s data such as address or telephone number changes, he shall correct online at once, and cannot deny his order or refuse to pay because of the incorrect data. ACARD has the right to accept your order or not. If the ordered product cannot be delivered twice, and over three days no one answers the telephone or e-mail from ACARD, ACARD will cancel the order and refund the full amount (but will deduct the freight).
3. For all online trades on the ACARD website, the consumer should agree to take ACARD’s electronic trade data as the base. If there is any quarrel, the electronic trade data shall be regarded as the norm. If the consumer finds the trade data incorrect, he shall notify the manager of ACARD e-commerce website at once.
4. When the consumer finds the product defective, he can contact us at first. If he wants to return the product, it must be a complete package, including the product, enclosure, etc. The consumer has to pay the freight otherwise we don’t accept the return. For the detailed regulations, refer to the procedures of online shopping.
5. The ACARD website may have many links. All the information on the linked websites or web pages is provided by the websites. ACARD does not guarantee the correctness, reliability or the instantaneousness of the contents.
The Safety of the System 1. The system does not guarantee the normal display of the consumer’s uploaded data, nor guarantee the correctness of data transfer. If the consumer discovers something wrong with the system, he shall notify the manager of ACARD e-commerce website at once.
2. The system will back up data regularly. Except for intentional or significant fault, the consumer should agree that the system doesn’t have to be responsible for the wrongly deleted data or failed backup.
The Modification of the Articles 1. Besides the articles, the consumer should follow the other related measures set for the online shopping by ACARD too.
2. ACARD reserves the right to modify the articles any time. The modified articles will be posted on the website. They won’t be sent to the consumer separately. The consumer should agree to follow the modified articles.
The Governing Law & the Jurisdiction 1. The articles and all the actions of online shopping on the ACARD website take the Law of Republic of China as the governing law.
2. For all quarrels resulting from the articles, ACARD and the consumer agree to take the district court in Panchiao, Taiwan, ROC as the jurisdiction court for the first trial.
